Smokin' Sarah Stogner Challenges Texas' Marijuana Laws

Texas is a mess. Two weeks ago, the legislature's Democrats fled the state to stop a GOP gerrymandering plan (they're back). A recent special session was called by Gov. Greg Abbott to iron out difference among lawmakers over Lt. Gov. Dan Patrick's efforts to ban hemp-derived THC (a.k.a. Delta 9). No agreement has been reached.

Meanwhile, Republican West Texas district attorney Sarah Stogner hit the national stage when she lit a joint on her ranch and broadcasted it via TikTok on Aug. 2. "Free the plant, Dan," she posted.

Stogner, who's 41, purchased flower at a legal shop across the border in New Mexico and rolled one up for her stunt.

"Our neighbors in New Mexico legalized pot several years ago," she wrote in an Austin American Statesman op-ed in May. "People in a large swath of Texas can just drive across the state line and enjoy these kinds of products there.

"It's important to keep in mind that we're talking about a plant that grows in nature," Stogner added. "Criminalizing possession of a plant, which requires no processing or other steps to contain THC, doesn't seem to be in keeping with the concept of freedom, which Texans hold dear."

Senate Bill 5, which would ban the sale of products containing any amount of THC, including hemp-derived THC products (they're currently allowed to contain no more than .03% of THC), passed the Texas Senate on Aug. 8 and was sent to the House. The bill is similar to SB3, which Abbott veteoed in June.
